The legislation of the Republic of Tajikistan guarantees accessibility and timeliness of psychological and medico-psychiatric assistance to all in need, in accordance with Articles No.160 and No. 181 of the Healthcare Code of the Republic of Tajikistan. This includes:

• Emergency medico-psychiatric assistance, consultative-diagnostic, therapeutic, preventive, and rehabilitation services. 

• Psychiatric examination and determination of temporary disability. 

• Pensions, social assistance, and support for employment for individuals with mental disorders. 

• Guardianship issues and legal consultations in psychiatric institutions. 

• Social and domestic arrangements for individuals with mental disorders, as well as their care.

• Education for disabled persons and minors with mental disorders.

The organization of medico-psychiatric assistance and social protection is carried out by ministries, departments, and executive authorities in accordance with their competence.

In summary, while Tajikistan's domestic laws and policies theoretically provide access to mental health care services for refugees, practical challenges such as limited resources, integration issues, and accessibility barriers hinder the effective delivery of these services.

    Article No.181 - Medical-Psychiatric Care

    The state guarantees the following for individuals suffering from mental disorders: Emergency medical-psychiatric care; Consultative, diagnostic, therapeutic, preventive, and rehabilitative assistance in both outpatient and inpatient settings; All types of psychiatric examinations, including the determination of temporary disability; Pensions, social and household assistance, and support for the employment of individuals with mental disorders; Resolution of guardianship issues; Legal consultations and other forms of legal assistance in psychiatric and psychoneurological institutions; Social and household arrangements for disabled and elderly individuals suffering from mental disorders, as well as care for them; Education for disabled persons and minors with mental disorders. The provision of medical-psychiatric care and social protection for individuals with mental disorders is carried out in accordance with the procedures established by the Government of the Republic of Tajikistan. The provision of all types of medical-psychiatric care and social protection for individuals with mental disorders is implemented by the relevant ministries, agencies, and local executive authorities, in accordance with their competencies as defined by the legislation of the Republic of Tajikistan.

    Articles No.160 - Combating Human Immunodeficiency Virus and Acquired Immunodeficiency Syndrome

    The state policy on combating the human immunodeficiency virus (HIV) and acquired immunodeficiency syndrome (AIDS) is implemented based on this Code and other regulatory legal acts of the Republic of Tajikistan. The state guarantees: The observance of all rights and freedoms in accordance with the legislation of the Republic of Tajikistan concerning people living with HIV, AIDS patients, and their family members; Epidemiological surveillance of the spread of HIV and AIDS in the Republic of Tajikistan, ensuring the priority of human rights, anonymous testing, and adherence to confidentiality principles; The provision of free, high-quality, scientifically based, and qualified medical and socio-psychological assistance to individuals infected with HIV, AIDS patients, and their family members; The accessibility and safety of medical examinations for HIV detection; The supply of preventive, diagnostic, and treatment measures for HIV infection, as well as monitoring the safety of medical drugs, biological fluids, and tissues used for diagnostic, therapeutic, and research purposes; The development of scientific research on HIV and AIDS-related issues; Regular public awareness campaigns regarding HIV and AIDS-related matters; The promotion of international cooperation and regular exchange of information within international programs to combat HIV and AIDS; The availability and timeliness of medical and socio-psychological assistance; The adoption of a periodic State Program to combat HIV and AIDS. Measures to combat HIV and AIDS are carried out by the Government of the Republic of Tajikistan and local state authorities. Enterprises, institutions, organizations, public associations (including international ones), as well as individuals, including foreign citizens, may participate in implementing these measures. The state, in accordance with the legislation of the Republic of Tajikistan, guarantees support to these individuals and legal entities in carrying out such programs.
