Selected provisions
When seeking and receiving medical care, a patient has the right to:
Respectful and humane treatment by medical professionals and support staff;
Choice of a doctor and healthcare organization;
Invitation of a lawyer or legal representative to protect their rights;
Other rights provided by this Code and other legislative acts of the Republic of Tajikistan.
The state policy on combating the human immunodeficiency virus (HIV) and acquired immunodeficiency syndrome (AIDS) is implemented based on this Code and other regulatory legal acts of the Republic of Tajikistan.
The state guarantees:
The observance of all rights and freedoms in accordance with the legislation of the Republic of Tajikistan concerning people living with HIV, AIDS patients, and their family members;
Epidemiological surveillance of the spread of HIV and AIDS in the Republic of Tajikistan, ensuring the priority of human rights, anonymous testing, and adherence to confidentiality principles;
The provision of free, high-quality, scientifically based, and qualified medical and socio-psychological assistance to individuals infected with HIV, AIDS patients, and their family members;
The accessibility and safety of medical examinations for HIV detection;
The supply of preventive, diagnostic, and treatment measures for HIV infection, as well as monitoring the safety of medical drugs, biological fluids, and tissues used for diagnostic, therapeutic, and research purposes;
The development of scientific research on HIV and AIDS-related issues;
Regular public awareness campaigns regarding HIV and AIDS-related matters;
The promotion of international cooperation and regular exchange of information within international programs to combat HIV and AIDS;
The availability and timeliness of medical and socio-psychological assistance;
The adoption of a periodic State Program to combat HIV and AIDS.
Measures to combat HIV and AIDS are carried out by the Government of the Republic of Tajikistan and local state authorities. Enterprises, institutions, organizations, public associations (including international ones), as well as individuals, including foreign citizens, may participate in implementing these measures. The state, in accordance with the legislation of the Republic of Tajikistan, guarantees support to these individuals and legal entities in carrying out such programs.
The state guarantees the following for individuals suffering from mental disorders:
Emergency medical-psychiatric care;
Consultative, diagnostic, therapeutic, preventive, and rehabilitative assistance in both outpatient and inpatient settings;
All types of psychiatric examinations, including the determination of temporary disability;
Pensions, social and household assistance, and support for the employment of individuals with mental disorders;
Resolution of guardianship issues;
Legal consultations and other forms of legal assistance in psychiatric and psychoneurological institutions;
Social and household arrangements for disabled and elderly individuals suffering from mental disorders, as well as care for them;
Education for disabled persons and minors with mental disorders.
The provision of medical-psychiatric care and social protection for individuals with mental disorders is carried out in accordance with the procedures established by the Government of the Republic of Tajikistan.
The provision of all types of medical-psychiatric care and social protection for individuals with mental disorders is implemented by the relevant ministries, agencies, and local executive authorities, in accordance with their competencies as defined by the legislation of the Republic of Tajikistan.
The primary duties of family medicine specialists include:
Implementing sanitary and educational measures to promote a healthy lifestyle and prevent diseases among the population;
Timely examination, early disease detection, and prevention at initial stages;
Ensuring regular health check-ups for family members as part of health improvement measures;
Providing emergency medical assistance when necessary;
Conducting consultations, timely hospitalization, and monitoring the treatment process as required;
Carrying out therapeutic, diagnostic, and health recovery measures within the established professional scope;
Determining temporary disability status and referring patients to the medical-social commission when necessary;
Providing medical and social assistance in cooperation with social service workers for lonely individuals, the elderly, disabled persons, and those with chronic illnesses;
Offering advisory support to families on vaccinations, child nutrition, upbringing, preparation for preschool and educational institutions, specialized care, family planning, behavior, psychology, hygiene, as well as social, medical, and sexual aspects of family life;
Cooperating with other healthcare specialists and social service workers when necessary to enhance the quality of medical services;
Properly maintaining and utilizing approved registration and reporting documents.
During the initial contact, family medicine specialists must address the patient’s medical issues and, if necessary, facilitate referrals to specialized medical professionals. The family doctor informs the patient of consultation results, provides details on all available medical services and their most effective forms, and ensures compliance with all medical advice and recommendations.
1) Individuals and legal entities in the healthcare sector, in order to ensure that the medical and pharmaceutical services they provide meet healthcare standards, are subject to accreditation in accordance with the procedure established by the Government of the Republic of Tajikistan.
2) Accreditation is mandatory and is carried out at the expense of the accredited entity and other funds that are not prohibited by the legislation of the Republic of Tajikistan.
1) The quality assessment of medical services is divided into internal and external assessments.
2) To conduct the internal assessment, each healthcare organization establishes a Quality and Safety Commission for Medical Care. The structure and composition of this Commission are approved by the head of the organization, taking into account the scope of medical services provided. The Quality and Safety Commission conducts ongoing analysis of medical care organization, clinical activities of the healthcare institution, identifies factors that violate medical care procedures and standards, and reviews, within 5 days, the complaints of patients receiving treatment. Based on the findings, the head of the healthcare organization is provided with recommendations to eliminate the causes and conditions of reduced quality of medical services.
3) The external assessment of medical services is conducted by the authorized state body for medical activity supervision in the form of scheduled and unscheduled inspections, as well as the accreditation of healthcare organizations, regardless of their ownership form and departmental affiliation.
4) The procedure for organizing and conducting internal and external quality assessments of medical services is established by the authorized state body in the field of healthcare.
The rights and duties of foreign nationals, stateless persons, and refugees in the territory of the Republic of Tajikistan in the healthcare sector are provided in accordance with international legal acts recognized by Tajikistan, this Code, and other legislative acts of the Republic of Tajikistan.
1) The reproductive health of the population of the Republic of Tajikistan is protected by the state. The authorized state body in the field of healthcare is responsible for overseeing the provision of reproductive health services, the activities of national organizations, state research and educational institutions, and developing the reproductive health protection strategy. Together with local executive authorities, it is responsible for ensuring that the population has access to reproductive health services.
2) The procedure for organizing the activities of state organizations in the field of reproductive health protection is established by the authorized state body in the field of healthcare.
1) Reproductive rights are based on the recognition of the fundamental rights of married couples to make free and responsible decisions about the number of children, the timing of their conception, and the intervals between births, as well as to access the necessary means and information to achieve reproductive health. Citizens have the right to independently:
- Decide on the number of children;
-Decide on the interval between births, taking into account medical and social conditions, ensuring effective upbringing of children;
-Use methods and means that protect individuals from diseases or injuries that may harm their sexual and reproductive functions.
2) The state guarantees:
-Prenatal and postnatal benefits for mothers;
-Protection from all forms of sexual exploitation and sexual harassment;
-Access to information aimed at promoting social, spiritual, and moral well-being, as well as physical and mental health in the context of childbirth.
1) Individuals who seek services in reproductive health organizations have the right to:
- Receive complete, accurate, and high-quality information about family planning methods and childbirth;
- Access medical services in the field of reproductive health and family planning;
- Choose a medical professional freely;
- Make free decisions regarding the use of safe methods;
- Confidentiality during consultations and physical examinations;
- Express opinions regarding contraceptive methods and the services provided;
- Receive information about the use of a specific contraceptive method and all the services provided.
