The legislation of the Kyrgyz Republic forms a solid legal basis for ensuring access to sexual and reproductive health services. The main rules regulating these rights are contained in the Law of the Kyrgyz Republic "On the Protection of Citizens' Health" dated January 12, 2024 No. 14, the Program of State Guarantees for Providing Citizens with Medical and Sanitary Care, approved by the Resolution of the Cabinet of Ministers of the Kyrgyz Republic dated September 21, 2023 No. 493 and the Regulation on the Kyrgyz Scientific Center for Human Reproduction, approved by the Resolution of the Cabinet of Ministers of the Kyrgyz Republic dated June 6, 2024 No. 295. Article 5 of the Law "On the Protection of Citizens' Health" establishes that state policy in the field of health protection is based on the principles of ensuring the availability of medical care to all segments of the population, including vulnerable groups. The article also enshrines the prohibition of discrimination; services must be provided to all citizens on equal terms, including persons with disabilities. Also, Article 5 of the Law of the Kyrgyz Republic "On the Protection of Citizens' Health" emphasizes the importance of maintaining confidentiality when providing medical services. The Law on the Protection of Citizens' Health defines reproductive health as a state of complete physical, mental and social well-being, allowing a person to make free and informed decisions regarding reproduction. 

Chapter 2 of the Program of State Guarantees for Providing Citizens with Medical and Sanitary Care, approved by Resolution of the Cabinet of Ministers of the Kyrgyz Republic dated September 21, 2023 No. 493, defines a list of essential services, including prevention, diagnosis and treatment of diseases of the reproductive system. This includes screening for infectious diseases, diagnosis of anemia in pregnant women, family planning consultations and ultrasound examinations of the fetus. 

The economic accessibility of services is ensured by the provisions of the State Guarantees Program approved by the Resolution of the Cabinet of Ministers of the Kyrgyz Republic dated September 21, 2023 No. 493, which also provides for the free provision of a basic package of services to pregnant women and children under 18 (Chapter 2, paragraphs 7.8 and 12). The physical accessibility of services is ensured through an extensive network of feldsher-obstetric stations providing primary health care (State Guarantees Program, Chapter 2, paragraph 5). According to Article 57, everyone has the right to affordable sexual and reproductive health services, including contraception, family planning and infertility treatment, and can control the number, timing and duration of their provision. birth of children. It also includes the right to artificial insemination, surrogacy and cryopreservation of gametes. The right to anonymous and non-anonymous donation of reproductive cells is also provided for somatically and mentally healthy citizens. Women have the right to safe abortion and independent reproductive choice. Surgical sterilization is also possible for adults. 

Health legislation also regulates the activities of specialized institutions, such as the Kyrgyz Scientific Center for Human Reproduction, which conducts scientific research, provides consultations and introduces high-tech treatment methods, which helps improve the quality of reproductive health services. Its functions are enshrined in paragraph 11 of the Regulation on the Kyrgyz Scientific Center for Human Reproduction under the Ministry of Health of the Kyrgyz Republic. The Kyrgyz Scientific Center for Human Reproduction operates on the basis of the Regulation on the Kyrgyz Scientific Center for Human Reproduction, approved by the Resolution of the Cabinet of Ministers of the Kyrgyz Republic dated June 6, 2024, No. 295.  

Thus, the legislation of the Kyrgyz Republic, including the Law "On the Protection of Citizens' Health", the State Guarantees Program and the Regulation on the Kyrgyz Scientific Center for Human Reproduction, provide a solid legal basis for citizens' access to sexual and reproductive health services. The main guarantees include the availability of medical care for all segments of the population, including vulnerable groups, free provision of essential medical services, protection of the rights to confidentiality and choice of contraception methods, as well as the possibility of using assisted reproductive technologies.

    Chapter 2 - Objectives and tasks of the Center

    9. The objective of the Center is to protect reproductive health, provide high-quality medical and preventive care to the population and carry out research activities in the field of obstetrics, gynecology, perinatology, medical genetics and assisted reproductive technologies in accordance with this Regulation and the development of innovative products capable of making a significant contribution to the socio-economic development of the country. 11. The Center, in accordance with the assigned tasks, performs the following functions: 1) provides highly specialized, highly qualified and high-tech medical care to the population; 2) participates in the work of expert commissions for the evaluation of programs and research results in the field of reproductive medicine; 3) conducts training of highly qualified scientific and practical personnel in the profile of the Center; 4) creates regional genetic databanks in areas of research and practical activities; 5) fulfills orders on a contractual basis in accordance with state programs for the protection of public health; 6) coordinates fundamental and applied scientific research on human reproductive function; 7) organizes and holds thematic, scientific and practical conferences and seminars on topical issues of reproductive medicine; 8) conducts clinical trials (on a contractual basis) of drugs, with the provision of an official conclusion on the possibility of introducing them into practical healthcare in the manner prescribed by law.

    Article 5 - Basic principles of state policy in the field of public health protection in the Kyrgyz Republic

    The basic principles of state policy in the field of public health protection in the Kyrgyz Republic are: 1) respect for the rights of citizens to health protection and non-discrimination in the provision of medical care, taking into account the age and gender needs of various social groups and ensuring social protection in the event of loss of health by citizens; 2) accessibility of medical and sanitary-preventive care for all groups of the population, creation of equal opportunities for persons with disabilities in receiving medical care; 3) development of the healthcare sector in accordance with the needs of all groups of the population by forming a comprehensive integrated system of medical care and creating equal conditions for the functioning of healthcare organizations, regardless of their form of ownership; 4) free/preferential use by citizens of medical and sanitary-preventive care within the framework of the State Guarantees Program; 5) responsibility of citizens for maintaining and strengthening their health, the health of their children, parents and other persons; 6) scientific validity of medical and sanitary measures; 7) preventive focus of healthcare with the formation of a commitment to a healthy lifestyle among the population with the active participation of the population and public organizations in resolving healthcare issues; 8) responsibility of state authorities and local governments, legal entities and officials for failure to provide state guarantees in maintaining and strengthening the health of citizens; 9) responsibility of persons providing medical and sanitary care for failure to provide its safety and quality; 10) voluntary donation of blood and its components, as well as a guarantee of maintaining health and respect for the rights of the donor when performing the donor function, with the provision of state guarantees and social protection; 11) priority of observance of human rights and freedoms in the implementation of sexual and reproductive rights; 12) the focus of state programs on improving the demographic development of the Kyrgyz Republic; 13) implementation of generally recognized principles and norms of international law, as well as international obligations of the Kyrgyz Republic.

    Article 57 - Reproductive Rights of Citizens

    1. Everyone has the right to comprehensive, accessible sexual and reproductive health services as an integral part of health care. 2. Citizens, regardless of their marital status, have the right to control and make a free, responsible decision regarding the number of children, the time of their birth, the intervals between births, including the use of modern methods of birth control. 3. Citizens have the right to access existing safe technologies for the protection of reproductive health, including contraception, family planning, termination of pregnancy, as well as diagnosis and treatment for infertility, sexually transmitted diseases, including HIV. 4. Citizens have the right to use artificial insemination methods: insemination, implantation and in vitro fertilization. 5. Citizens, regardless of medical indications and marital status, have the right to parenthood using the method of surrogacy. 6. Citizens have the right to cryopreservation and storage of their reproductive cells, reproductive organ tissues and embryos. The spouse, father, mother, children, siblings have the right to use stored reproductive cells for the purpose of reproduction in the event of the death of the person. 7. Adult citizens, somatically and mentally healthy, who have undergone a medical and genetic examination, have the right to be anonymous and non-anonymous donors of reproductive cells. Anonymous donors do not have the right to information about the fate of their reproductive cells. 8. Women, regardless of marital status, have the right to independent reproductive choice, including the choice of safe abortion. 9. Citizens who have reached marriageable age have the right to voluntarily use surgical sterilization.

    Chapter 2 - Primary health care

    7. The basic package of medical services is provided free of charge to all citizens of the Kyrgyz Republic registered with the Family Medicine Center/General Practice Center, refugees and asylum seekers in the Kyrgyz Republic, as well as Kairylmans, upon presentation of a certificate confirming their status. 8. Basic package of medical services for pregnant women: 1) with physiological pregnancy: - general blood test; - general urine test; - determination of protein in urine; - blood type; - HIV examination; - ultrasound examination of the fetus; - syphilis test; - gonorrhea test; - oral glucose tolerance test; - hemoglobin level; - vaginal and cervical canal sampling; - urine analysis for bacteriuria using Gram staining (for women in the first trimester of pregnancy), trichomoniasis if indicated; - tuberculosis screening if indicated; - detection of psychoactive substance use; - preventive talks about breastfeeding, caring for a healthy newborn, postpartum contraception and family planning, warning signs for the mother and newborn, nutrition, lifestyle and routine in the postpartum period; 2) with pregnancy pathology, including tuberculosis and HIV: - outpatient specialized medical care; - management of pregnant women with a high risk factor; - hospitalization if indicated; - for management of a woman in the postpartum period up to 10 weeks; - postnatal care/home visit by a family doctor/nurse; - screening for depression/abuse and specialized outpatient care; - training on breastfeeding, healthy newborn care, postnatal contraception and family planning, warning signs for mother and newborn, nutrition, lifestyle and routine in the postnatal period. 12. Conditions for the provision of basic health care packages: - free of charge for pregnant women; - free of charge for children aged 0 to 18.
