Analysis

The legislation of the Kyrgyz Republic in the sphere of external migration establishes that identity documents are documents confirming the status of a person crossing the state border of the Kyrgyz Republic, who was sent through diplomatic channels and is recognized by the Kyrgyz Republic in this capacity, unless otherwise provided by international treaties that have entered into force in the manner prescribed by law, to which the Kyrgyz Republic is a party. Also, the Law on External Migration of July 17, 2000 № 61 regulates the procedure for crossing the state border by foreign citizens and stateless persons, including their entry, stay, transit and exit. Citizens of a foreign country, for whom a visa-free regime applies, may enter, exit, transit, move and stay on the territory of the Kyrgyz Republic without a visa, on the basis of one of the valid documents, for countries with which a visa regime has been established - a foreign citizen or stateless person may enter the Kyrgyz Republic and exit the Kyrgyz Republic on the basis of valid documents and visas for entry into the Kyrgyz Republic or exit from the Kyrgyz Republic. In accordance with the Instructions for checking documents of persons crossing the State Border of the Kyrgyz Republic by the border control bodies of the State Border Service of the Kyrgyz Republic dated January 16, 2019, № 1, approved by the Order of the State Border Service of the Kyrgyz Republic, foreign citizens and stateless persons enter the territory of the Kyrgyz Republic through checkpoints on the State Border open for international traffic, with valid documents and visas, unless otherwise provided by international treaties of the Kyrgyz Republic. The category of documents for the right to enter the territory of the Kyrgyz Republic or exit from the territory of the Kyrgyz Republic for foreign citizens and stateless persons includes diplomatic, service and foreign passports of citizens of foreign states, national passports, identity cards of stateless persons, seamen's passports, travel documents (certificate, certificate) for returning to the country of their citizenship, passports of UN employees, certificates of aircraft crew members, travel documents of refugees and other documents issued in accordance with international treaties.

Thus, the legislation of the Kyrgyz Republic recognizes valid travel documents issued by foreign states as official identity documents for the purpose of crossing the state border, if they comply with international norms and agreements to which the Kyrgyz Republic is a party.
