Do domestic laws and policies provide access to secondary and tertiary healthcare services for forcibly displaced and stateless persons?

The domestic laws and policies of the Kyrgyz Republic provide the right to access secondary public health services, including specialized care. However, this right is accompanied by the condition of compulsory health insurance.
According to the State Guarantee Program for Providing Citizens with Medical and Sanitary Care approved by the Cabinet of Ministers of the Kyrgyz Republic of September 21, 2023 № 493, access to rehabilitation and physiotherapy services at the outpatient level, such as galvanization, electrophoresis, UHF (ultra-high frequency therapy) and others, is provided without providing medicines to citizens at the FMC/GPC upon a referral from a specialist and is provided to the following categories of citizens on preferential terms (50% of the cost of the service according to the price list):
-Citizens for whom contributions to compulsory health insurance are paid.
-Persons with a compulsory health insurance policy, including those who pay contributions themselves.
-Pensioners up to 70 years old.
-Children up to 16 years old (up to 18 years old in case of studying in general educational institutions).
-Officially registered unemployed.
- Full-time students up to 21 years of age.
- Military personnel.
- Persons receiving social benefits.
Inpatient care is provided by inpatient care departments in family medicine centers and general practice centers to citizens of the Kyrgyz Republic. It is provided without providing medicines and medical products, provided that:
- registration with the state health care system (SHS);
- a referral from a family doctor.
On preferential terms (50% of the cost of medical services according to the price list), inpatient care is available to the following categories of citizens:
- Working citizens for whom contributions to compulsory health insurance are received.
- Persons with a compulsory health insurance policy, including those who pay contributions themselves.
- Members of peasant (farming) households who pay contributions for compulsory health insurance.
- Pensioners up to 70 years of age.
- Children under 16 (or under 18 if studying in general education organizations or madrassas).
- Officially registered unemployed.
- Full-time students under 21.
- Military personnel.
- Persons receiving monthly social benefits.
Specialized medical care is provided by specialists:
- Family Medicine Centers;
- General Practice Centers;
- Outpatient Diagnostic Departments (ODDs) of hospitals;
- Consultative Diagnostic Departments (CDDs) of hospitals.
Reception, examination, consultation and prescription of treatment by specialists of ADO (outpatient diagnostic departments) and KDO (consultative diagnostic departments) of hospitals is free of charge for citizens specified in paragraphs 1–3 of Chapter 17 of the Procedure, upon receipt of a referral from a PMSC (primary health care) specialist to FMC (family medicine centers) or GP centers. Such categories include those insured under compulsory health insurance, including employed citizens, persons with a compulsory health insurance policy, pensioners under 70 years of age, children under 16 years of age (or under 18 years of age if studying), officially registered unemployed, full-time students under 21 years of age, military personnel, as well as persons receiving social benefits and other preferential groups.
According to regulatory documents, access to secondary public health services, including specialized care, is provided on preferential terms (50% of the cost according to the price list) for a wide range of privileged categories of citizens, including children, pensioners, officially registered unemployed, students, military personnel and others. This right is ensured through the compulsory health insurance system and is implemented within the framework of the State Guarantees Program of September 21, 2023 № 493. Specialized care is also provided free of charge upon referral from primary health care specialists for insured persons. Thus, state policy is aimed at ensuring the availability of secondary health care for various segments of the population, especially for socially vulnerable groups. This system complies with international standards, including the provisions of the ICESCR, which provide for the right to access health services and ensure the highest standard of health.

Chapter 3 - Outpatient rehabilitation and physiotherapeutic care
19. Rehabilitation and physiotherapeutic care is provided to citizens at the FMC/FGP without providing medications upon presentation of a referral from a specialist. 20. Outpatient rehabilitation and physiotherapeutic services: - galvanization; - electrophoresis; - ultra-high-frequency therapy (UHF); - ultrasound therapy; - ultraviolet irradiation. 21. Conditions for the provision of outpatient rehabilitation and physiotherapeutic care: - free of charge to citizens specified in paragraphs 2-3 of Chapter 17 of this Procedure; - on preferential terms in the amount of 50 percent of the cost of the medical service according to the Price List to citizens specified in paragraph 1 of Chapter 17 of this Procedure; - all other citizens are provided with rehabilitation and physiotherapeutic medical care on a paid basis according to the Price List.
Chapter 4 - Inpatient care
22. Inpatient care (day hospital) is provided by the inpatient care departments of the Family Medicine Center/General Practitioner Center to citizens of the Kyrgyz Republic without providing medicines and medical products, subject to registration with the Family Doctor’s Group and a referral from a family doctor. 23. Conditions for the provision of inpatient care: - free of charge for citizens specified in paragraph 2 of Chapter 17 of this Procedure (socially vulnerable categories of citizens); - on preferential terms in the amount of 50 percent of the cost of the medical service according to the Price List for citizens specified in paragraphs 1 and 3 of Chapter 17 of this Procedure; - all other citizens are provided with inpatient care on a paid basis according to the Price List.
Chapter 5 - Specialized outpatient medical care (SOC/CO)
24. Specialized outpatient medical care is provided by specialists of: - family medicine centers; - general practice centers; - outpatient diagnostic departments of hospitals; - consultative diagnostic departments of hospitals. 25. Conditions for the provision of specialized outpatient medical care (SOC): - specialized outpatient medical care at the FMC/COPC level is provided under the conditions specified in Chapters 1-4; - specialized outpatient medical care at the hospital level, including admission, examination, consultation and prescription of treatment by SOC/COPC specialists, is provided free of charge upon a referral from a PHC specialist (FMC/COPC) for citizens specified in paragraphs 1-3 of Chapter 17 of this Procedure; - in hospital ADO/KDO laboratory diagnostic tests specified in paragraphs 6 and 13 of this Procedure, subject to a referral from a PHC specialist (CSM/CVP), are provided on a fee-based basis at the expense of the referring PHC organization; - in hospital ADO/KDO laboratory diagnostic tests in addition to the tests specified in paragraphs 6 and 13 of this Procedure, subject to a referral from a PHC specialist (CSM/CVP), are provided on a fee-based basis according to the Price List. Rehabilitation, physiotherapy, and inpatient-replacing care in hospital ADO/KDO for outpatients is provided on a fee-based basis according to the Price List. 26. Citizens who apply to a hospital ADO/KDO without a referral from a CSM/CVP specialist, regardless of their entitlement to benefits, are paid according to the Price List. 27. Citizens, regardless of their entitlement to benefits, independently pay for the cost of expensive examinations and manipulations. The cost of expensive examinations and manipulations is determined according to the Price List.
