The legislation of the Kyrgyz Republic grants refugees the right to acquire movable and immovable property, as well as to exercise other property rights equally with foreign citizens and stateless persons, unless otherwise provided by law. This is in line with the obligations assumed by Kyrgyzstan under the Convention relating to the Status of Refugees, which requires that refugees be provided with conditions no less favorable than those provided to foreign citizens in similar circumstances.
Unlike refugees, asylum seekers are in a more vulnerable position. Their application registration certificate and status are temporary until the final decision is made by the authorized body, while according to Article 3 of the Law on the Legal Status of Foreign Citizens of December 14, 1993 №1296-XII, foreign citizens can permanently reside in the Kyrgyz Republic if they have permission to do so, issued by a residence permit issued by an authorized state body in the field of registration of population rights, or the status of a compatriot with foreign citizenship, or refugee status, or stateless person. Foreign citizens who are in the Kyrgyz Republic on other legal grounds are considered temporarily staying. They are required to register their foreign passports or replacing documents in accordance with the established procedure and leave the republic upon expiration of the specified period of stay, accordingly, asylum seekers are in a more limited status for the implementation of their property rights, moreover, they are not allowed to officially work, which further limits their financial situation. According to Article 13 of the Law "On Refugees" of March 25, 2002 №44, refugees have the right to acquire immovable property under the conditions established for foreign citizens and stateless persons. This allows refugees to own real estate, with the exception of restrictions related to the acquisition of land or objects of strategic importance, which are applied to foreign citizens in accordance with the law.
Refugees and asylum seekers have the right to open bank accounts. According to the Instructions for working with bank accounts, deposit accounts, approved by the Resolution of the Board of the National Bank of the Kyrgyz Republic of October 31, 2012 № 41/12, the rights of foreign citizens, stateless persons and residents when opening accounts are equal. This additionally requires the provision of a document confirming the right to stay or reside in the Kyrgyz Republic.
Asylum seekers can use the asylum seeker's certificate as a document confirming the right to stay in the territory of the Kyrgyz Republic to open an account, subject to the availability of a valid identity document.
In practice, there may be cases of banks refusing to open an account due to ignorance of the legal status of refugees and citing internal regulations, which may create additional administrative barriers that do not reflect the policy of the country as a whole.
Refugees and asylum seekers have the right to purchase and register vehicles. According to the Rules of state registration of vehicles, installations and equipment, approved by the Resolution of the Government of the Kyrgyz Republic of June 23, 2017 № 407, registration is possible on the basis of the following documents:
- Passport with a valid visa (at least six months);
- Other identity document;
- Residence permit;
- Registration card or other registration document issued by an authorized body.
The certificate of an asylum seeker is recognized as a document confirming registration on the territory of Kyrgyzstan and can be used to register a vehicle if there is a valid identity document.
The rules stipulate that vehicles belonging to refugees are subject to issuance of state registration plates in the manner established for individuals and legal entities of the Kyrgyz Republic.
According to Article 51,52, 53 of the Civil Code of the Kyrgyz Republic of May 8, 1996 № 15, foreign citizens and stateless persons have civil legal capacity on an equal basis with citizens of Kyrgyzstan. This provision also applies to refugees. Asylum seekers may act as parties to civil law relations and enter into transactions, provided they provide a valid passport and an asylum seeker certificate confirming their registration at their place of residence.
It should be noted that most civil law transactions require notarization. According to the Instruction on the procedure for performing notarial acts by officials of local government bodies, approved by the Ministry of Justice of the Kyrgyz Republic Of December 29, 2023 № 218, certification of transactions of refugees is carried out on the basis of documents certifying their identity and status, i.e., a refugee certificate. The identity of foreign citizens is established on the basis of their national passports, therefore, asylum seekers may act as a party to a transaction, provided they have a valid passport and an asylum seeker certificate, as a document confirming their registration at their place of residence.
The legislation of the Kyrgyz Republic provides refugees with access to the acquisition of movable immovable property, as well as other property rights on an equal basis with foreign citizens and stateless persons. These provisions are in line with Kyrgyzstan's obligations under the Convention relating to the Status of Refugees. However, in practice, in most cases, asylum seekers may face administrative obstacles due to their temporary status and the absence of the concept of an asylum seeker in other legal acts. Such cases can be challenged in accordance with the legislation of the Kyrgyz Republic, which confirms the need for further joint improving law enforcement practices.

Article 13 - Rights and obligations of a refugee in the Kyrgyz Republic
A person recognized as a refugee in the Kyrgyz Republic enjoys the same rights and bears the same obligations as foreign citizens permanently residing in the Kyrgyz Republic. A person recognized as a refugee in the Kyrgyz Republic shall also be granted the rights and obligations of a person applying for refugee status, as stipulated by Article 6 of this Law. A person recognized as a refugee in the Kyrgyz Republic and his family members shall have the right to: - reside for three months in a temporary settlement; - choose a settlement from among those proposed by the Authorized Body in which his relatives reside as their place of permanent residence, subject to their consent to cohabitation; - work for hire or engage in entrepreneurial activity in accordance with the legislation of the Kyrgyz Republic; - acquire real estate under the conditions established for foreign citizens and stateless persons by the legislation of the Kyrgyz Republic; - receive, with the assistance of the relevant state bodies of the Kyrgyz Republic, information about property left behind in the state of previous residence; - have the necessary documents proving his identity and travel documents; - to receive medical care on an equal basis with citizens of the Kyrgyz Republic; - to receive administrative assistance when applying to state bodies of the Kyrgyz Republic; - to mandatory registration of civil status acts and receipt of relevant documents.
