In accordance with Article 45 of the Constitution of the Kyrgyz Republic, low-income and other needy persons have the right to receive housing from state, municipal and other housing funds or in social institutions in the manner prescribed by law. This provision enshrines the social responsibility of the state and provides a legal basis for the development of mechanisms for providing citizens with affordable housing.
Access to state and social housing is regulated by regulations and state programs aimed at protecting the most vulnerable categories of citizens.
1. The Regulation on the procedure for providing residential premises of the state specialized housing stock under the Ministry of Labor and Social Development of the Kyrgyz Republic dated January 16, 2020 № 10, was developed in accordance with the Constitution, the Housing Code of the Kyrgyz Republic dated July 9, 2023 № 117:
- Establishes transparent mechanisms for registration, priority and distribution of housing.
- Regulates the procedure for transferring residential premises to a specialized housing stock and establishes the rules for their use, including grounds for eviction. This document is aimed at providing housing to socially vulnerable groups, such as: low-income citizens, disabled people, large families.
2. The housing program “My Home” for 2021-2026, approved by the Resolution of the Cabinet of Ministers of the Kyrgyz Republic dated July 13, 2021 № 75 as part of the implementation of the National Strategy for Sustainable Development of the Kyrgyz Republic for 2018-2040 (Presidential Decree dated October 31, 2018 № 221).
- The main goal of the program is to increase the availability of housing through state support, development of mortgage lending and stimulation of construction.
- The main areas of the program include:
- Increasing construction volumes and reducing housing costs.
- Support for vulnerable segments of the population (low-income, large families, public sector employees).
- Attracting extra-budgetary sources of financing and developing public-private partnerships.
- Stimulating the construction industry and creating jobs.
Despite the thoughtfulness of the legislative framework and programs, their effect is limited by the following factors:
- Strict restrictions on obtaining housing: Social and state housing is provided only to citizens of the Kyrgyz Republic. This is due to the limited resources and the need for priority for citizens in the context of housing shortages.
- Exclusion of refugees and asylum seekers: These categories of the population are not entitled to receive social housing, which complicates their integration and access to basic social rights.
The legislation of the Kyrgyz Republic creates a solid basis for social protection of the population, but its effectiveness is limited by the exclusion of certain groups of the population, including asylum seekers and refugees.

Article 45 - Right to housing
1. Everyone has the right to housing. 2. No one may be arbitrarily deprived of housing. 3. State bodies and local governments encourage housing construction and create conditions for the implementation of the right to housing. 4. Low-income and other needy persons are provided with housing from state, municipal and other housing funds or in social institutions on the grounds and in the manner prescribed by law.
