Do domestic laws and policies provide access to social protection for forcibly displaced and stateless persons?

The Constitution of the Kyrgyz Republic establishes social guarantees for citizens, foreign citizens and stateless persons. In accordance with Article 19 of the Constitution of the Kyrgyz Republic, the state undertakes to care for the welfare of the people, provide social protection, support socially vulnerable categories of the population, guarantee labor protection and health, and develop a system of social services, medical care and state benefits. Article 44 of the Constitution establishes the right to social security at the expense of the state in cases stipulated by law, such as old age, illness, disability, loss of ability to work or breadwinner. According to Article 52 of the Constitution of the Kyrgyz Republic, foreign citizens and stateless persons have equal rights and obligations with citizens, except for cases expressly provided for by the laws of the Kyrgyz Republic or international treaties. However, national legislation limits the access of foreign citizens to state benefits. The main regulatory act governing the provision of state benefits is the Law of the Kyrgyz Republic "On State Benefits in the Kyrgyz Republic" dated July 28, 2017 № 163. Article 3 of this law states that it applies to foreign citizens residing in the territory of the Kyrgyz Republic only if there is an international treaty concluded between the Kyrgyz Republic and the applicant's state of citizenship. In the absence of such an agreement, foreign citizens are not entitled to receive state benefits. In addition, foreign citizens are required to have a residence permit in order to apply for social benefits. Persons with refugee status are not included in the list of categories entitled to receive state benefits. The Regulation on the procedure for paying state benefits approved by the Resolution of the Government of the Kyrgyz Republic dated December 29, 2009 № 823 does not contain rules providing for the possibility of providing them to this category of persons, which creates legal uncertainty and contradicts the state's obligations under the 1951 Convention relating to the Status of Refugees. The Convention requires that refugees be granted equal rights with citizens in terms of social protection. 

The Constitution of the Kyrgyz Republic guarantees social security for persons with disabilities. The Law of the Kyrgyz Republic "On the Rights and Guarantees of Persons with Disabilities" of April 3, 2008, № 38, establishes equal rights for such persons to receive social benefits, compensation and services, regardless of their place of residence and disability group. Article 7 of the Law sets out measures of social support, including pension provision, social benefits, rehabilitation and provision of technical means. 

Medical care for persons with disabilities is provided within the framework of the State Guarantees Program for the Provision of Medical and Sanitary Care, approved by the Resolution of the Cabinet of Ministers of the Kyrgyz Republic dated September 21, 2023, № 493. For foreign citizens and stateless persons, access to this program is possible only with compulsory medical insurance and registration in primary health care institutions. 

However, there are still significant legal gaps in relation to refugees. The Law of the Kyrgyz Republic "On Refugees" dated March 25, 2002, № 44 obliges state bodies and local governments to facilitate the provision of places in social protection institutions, but does not contain specific provisions on the recognition of disability and the provision of social assistance to refugees with disabilities. 

On March 13, 2019, by Law № 34, the Kyrgyz Republic ratified the UN Convention on the Rights of Persons with Disabilities, adopted on December 13, 2006. The Convention obliges member states to ensure equal rights for persons with disabilities, including the right to social protection. However, the integration of the provisions of the Convention into national legislation requires further systematization. For example, there is no mechanism for providing social support to refugees with disabilities, which is contrary to international standards. 

The legal system of the Kyrgyz Republic provides significant social guarantees for citizens and persons with disabilities, but limits the access of foreign citizens and refugees to state support. The lack of clear regulation of issues of social protection of refugees, including those with disabilities, creates legal gaps and requires revision of legislation to fully comply with the international obligations of the Kyrgyz Republic and ensure social justice.
