Do domestic laws and policies provide for acceptable quality education standards for education for forcibly displaced and stateless persons?

Ensuring an acceptable quality of education is a key aspect of realizing the right to education, enshrined in international and national standards. In the Kyrgyz Republic, domestic legislation details the mechanisms and requirements aimed at achieving quality education, which allows assessing their compliance with international standards. Article 5 of the Law "On Education" of August 11, 2023 №179 directly enshrines state guarantees for ensuring the right to education, including the creation of an education system that meets the interests of the individual, society and the state. In accordance with this article, education is aimed at achieving quality that meets personal, social, professional and state standards. Article 3 of the Law defines the quality of education - a comprehensive characteristic of the education system, educational organization and individual educational achievements of the student, reflecting the degree of compliance with social and personal expectations, state educational standards, professional standards and international educational programs of which the Kyrgyz Republic is a participant. The approach to the quality of education in the Law covers both individual educational achievements and the systemic level, including educational organizations and state standards. This is consistent with international requirements, such as Article 13 of the International Covenant on Economic, Social and Cultural Rights (ICESCR), which emphasizes the importance of accessibility and acceptability of education.
Article 17 of the Law "On Education" of August 11, 2023 №179 describes the system of monitoring and evaluating the quality of education, which includes:
- Internal and external quality assurance systems.
- Establishment of the Department for the Development of Education Quality, which is independent and transparent.
- Monitoring and evaluating the quality of education through the collection, analysis and public presentation of data on the quality of education.
- Accreditation of educational organizations in accordance with state standards or international programs.
Moreover, the authorized body in the field of education organizes an assessment of the quality of formal education for compliance with state educational standards and (or) international educational programs to which the Kyrgyz Republic is a participant. The assessment of the quality of education is carried out by independent experts or organizations on the basis of a system of random testing and (or) other assessment procedures. The procedure for conducting random testing and assessing the quality of education for compliance with state educational standards and (or) international educational programs is approved by the Cabinet of Ministers. These mechanisms are aimed at ensuring that education meets modern requirements and create conditions for systemic quality analysis.
In order to improve the quality of education through the introduction of new generation educational standards, the Resolution of the Cabinet of Ministers dated July 22, 2022 №393 approved the State Educational Standard of School General Education, which:
- Establishes the goals and objectives of school education, key competencies and levels of their achievement.
- Defines the principles of objective assessment of educational results at the level of the system, school and student.
- Maintains the continuity of standards at all levels of education and helps reduce the academic workload.
This standard is aimed at ensuring that educational services meet the cultural and professional requirements of society, as well as ensuring the competitiveness of students in the labor market. An important aspect is the involvement of all participants in the educational process, including parents, teachers, civil society and the business community, which strengthens the connection between educational policy and the real needs of society.
Thus, the provision of quality education in the Kyrgyz Republic covers such aspects as:
- Relevance of the content of education (compliance with social and professional requirements).
- Cultural acceptability (taking into account national values).
- Quality of educational processes (training of teachers, modern teaching methods).
These aspects are consistent with the purpose of education defined in Article 13 of the ICESCR and Article 29 of the Convention on the Rights of the Child: promoting the all-round development of the individual, respect for human rights, mutual understanding and tolerance.
The results of monitoring the quality of education are used exclusively to improve educational processes, which is enshrined in Article 17 of the Law "On Education" of August 11, 2023 №179. This prevents the possibility of applying disciplinary measures based on monitoring and emphasizes the goal of improvement, not punishment. This approach encourages educational organizations to actively participate in the processes of assessing and improving quality.
Based on the analysis, it can be concluded that the legislation of the Kyrgyz Republic ensures acceptable quality of education through the introduction of educational standards, systematic monitoring, transparent assessment mechanisms and accreditation. Established these standards comply with international requirements, ensuring that education in the country is relevant, culturally acceptable and of high quality. This allows for the implementation of the constitutional right to education aimed at the comprehensive development of the individual.

Article 5 - State guarantees of the right to education
The state guarantees the implementation, protection and defence of the right of citizens to education by: 1) creating an education system that meets the interests of the individual, society and the state, aimed at achieving quality education for everyone; 2) creating conditions for the implementation of the right of citizens to receive free pre-school, primary, basic and secondary general education, as well as primary vocational education within the framework of state educational standards; 3) creating conditions for everyone's access to secondary and higher vocational, as well as postgraduate vocational education; 4) creating equal opportunities, inclusive education and the inadmissibility of any manifestations of discrimination in obtaining education; 5) creating equal conditions for the development of various forms of education and types of educational organizations; 6) creating conditions for effective interaction between the state, local communities, participants in the educational process and civil society in matters of forming and implementing state policy in the field of education; 7) effective and targeted use of budgetary funds allocated for education; 8) creating conditions for the publication of textbooks, including textbooks published in Braille, teaching aids and methodological manuals (educational and methodological complexes and educational and didactic materials).
Article 17 - Monitoring and Evaluation of the Quality of Formal Education
1. The education quality assurance system includes a systematic and consistent process of education quality management implemented through the internal and external education quality assurance systems. 2. For the purposes of monitoring and evaluating the quality of formal education, the authorized state body in the field of education shall establish in its structure the Department for the Development of Education Quality, which shall operate on the principles of independence, autonomy and transparency. The Head of the Department shall be appointed to the position and dismissed from the position by the Chairman of the Cabinet of Ministers upon the submission of the head of the authorized state body in the field of education. 3. For the purposes of obtaining reliable, complete and objective information on the quality of education in the Kyrgyz Republic, the authorized state body in the field of education shall monitor the quality of education through regular collection, storage, processing and analysis of data on the most significant characteristics of the quality of education in the Kyrgyz Republic. 4. The authorized body in the field of education shall organize the assessment of the quality of formal education for compliance with state educational standards and (or) international educational programs in which the Kyrgyz Republic is a participant. The assessment of the quality of education is carried out by independent experts or organizations on the basis of a system of random testing and (or) other assessment procedures. The procedure for conducting random testing and assessing the quality of education for compliance with state educational standards and (or) international educational programs is approved by the Cabinet of Ministers. 5. The results of monitoring and assessing the quality of formal education are used to formulate state policy in the field of education, take timely measures to improve the quality of education, including providing recommendations and assistance to educational organizations to achieve higher indicators of the quality of education. The results of monitoring and assessing the quality of education are not grounds for applying disciplinary measures. The results of monitoring and assessing the quality of formal education (except for personal data) are public information. 6. The procedure for determining the rating of educational organizations and programs, assessing the achievements of students are established by the authorized state body in the field of education. 7. The Department for the Development of Education Quality establishes the procedure for certifying the authenticity of educational documents issued in the Kyrgyz Republic, and also recognizes the authenticity of educational documents issued abroad.
