Domestic laws recognize the right of all persons living in Costa Rica, including asylum seekers and refugees, to seek judicial redress. Depending on the issue, the plaintiff may resort to ordinary courts (civil, administrative, etc.) or to the constitutional jurisdiction in case of violation of a fundamental right or constitutional norm. In this situation, the Constitution provides at Article 48 the remedy of Amparo that falls under the competence of the Constitutional Chamber of the Supreme Court of Justice (Sala Constitucional de la Corte Suprema de Justicia).
Article 41 of the Constitution further establishes that everyone must find redress for injuries or damages they have suffered in their person, property, or moral interests. Justice must be swift, complete, without denial, and in strict conformity with the laws.
