Description
The Law of the Kyrgyz Republic #1296-XII "On the Legal Status of Foreign Citizens", dd. December 14, 1993, determines the basic rights, freedoms, and responsibilities of foreign citizens in the Kyrgyz Republic, as well as foreign citizens who have acquired the status of compatriots with foreign citizenship, establishes the conditions and procedure for assigning and terminating such status.
Selected provisions
In the Kyrgyz Republic, foreign citizens and stateless persons enjoy rights and fulfill obligations equally with citizens of the Kyrgyz Republic, except in cases established by law or an international treaty that has entered into force in the manner prescribed by law, to which the Kyrgyz Republic is a party.
Foreign citizens and stateless persons in the Kyrgyz Republic are equal before the law regardless of gender, race, language, disability, ethnicity, religion, age, political or other beliefs, education, origin, property or other status, as well as other circumstances.
With respect to citizens of those states that have special restrictions on the rights and freedoms of citizens of the Kyrgyz Republic, with the exception of refugees and persons applying for refugee status, regulatory legal acts of the Kyrgyz Republic may establish reciprocal restrictions in order to protect national security, public order, protect the health and morals of the population, and protect the rights and freedoms of other persons. The use of their rights and freedoms by foreign citizens and stateless persons in the Kyrgyz Republic must not harm the rights and legitimate interests of citizens of the Kyrgyz Republic and other persons, the interests of society and the state.
Foreign citizens permanently residing in the Kyrgyz Republic may work as workers and employees at enterprises, institutions and organizations or engage in other labor activities on the grounds and in the manner established for citizens of the Kyrgyz Republic. Temporarily staying foreign citizens may engage in labor activities if this is compatible with the purposes and duration of their stay in the Kyrgyz Republic, or if the relevant permission has been received from the authorized state body in the field of migration in the manner determined by the Cabinet of Ministers of the Kyrgyz Republic. Foreign citizens may not be appointed to certain positions or engage in certain labor activities if, in accordance with the legislation, appointment to these positions or engagement in such activities is associated with belonging to the citizenship of the Kyrgyz Republic. Foreign citizens enjoy rights and bear obligations in labor relations equally with citizens of the republic.
Foreign citizens and stateless persons permanently residing in the Kyrgyz Republic, as well as temporarily residing foreign citizens, have the right to receive pensions, benefits and other forms of social security in accordance with the legislation of the Kyrgyz Republic, as well as international treaties that have entered into force in accordance with the legislation of the Kyrgyz Republic.
Foreign citizens have the right to receive an education equally with citizens of the Kyrgyz Republic in accordance with the procedure established by the legislation of the Kyrgyz Republic. Foreign citizens admitted to educational institutions of the Kyrgyz Republic have the rights and bear the obligations of pupils and students in accordance with the legislation of the Kyrgyz Republic.
Foreign citizens in the Kyrgyz Republic may enter into and dissolve marriages with citizens of the Kyrgyz Republic and other persons in accordance with the legislation of the Kyrgyz Republic. Foreign citizens enjoy rights and bear obligations in marital and family relations equally with citizens of the Kyrgyz Republic.
Foreign citizens in the Kyrgyz Republic have the right to appeal to the court and other state bodies to protect their personal, property, family and other rights.
They enjoy procedural rights in court on an equal basis with citizens of the Kyrgyz Republic.
