Description

The Immigration Proclamation sets out rules and regulations for foreigners in the requirements of getting into or departing from Ethiopia. It also gives a guide to how a foreigner can register and earn a residence permit. Specifically, it administers the manner and procedure of removal of foreigners illegally staying in the country, including refugees. It also administers documentation of refugees travel document, residence permit etc.

Article 14(2) - Foreigners not Required to Register

A foreigner exempted from registration pursuant to this Article shall obtain an identity card issued by the appropriate authority within thirty days from the date of his arrival.

Article 3(1) Requirements

Any foreigner who wants to enter into Ethiopia shall possess a valid travel document.

Article 2(4) Definitions

Travel document means any passport or other travel document, issued by the Ministry or the Authority or by foreign state recognized by the Government of Ethiopia or international or regional organization, bearing the identity and nationality of the holder.

Article 11(1) (f) Types and Issuance of Travel documents

Refugees’ travel document shall be one of among the travel documents to be issued in accordance with the Immigration proclamation and regulation.

Article 14 (1) (b) Foreigners not Required to Register

Foreigners not Required to Register. The following foreigners may not be required to register: (b) a foreigner who is recognized as a refugee by the Government of Ethiopia and the United Nations High Commission for Refugees.

Article 16(2) (c) Immigration Officer

Detain for investigation; (I) any person who is attempting to enter or depart from Ethiopia; or (II) any foreigner residing in Ethiopia; in violation of the requirements under this proclamation or of any Regulations issued hereunder.”

Article 16 (3) Immigration Officers

Any person detained by an Immigration Officer pursuant to the provisions of Sub-Article (2) (c) of this Article shall be brought to the competent court without delay in accordance with the law.

Article 16(2) (c)

An immigration officer shall detain for investigation; (I) any person who is attempting to enter or depart from Ethiopia; or (II) any foreigner residing in Ethiopia; in violation of the requirements under this proclamation or of any Regulations issued hereunder.

Article 8 (3) Deportation

The Authority may detain the foreigner against whom the deportation order is issued until he leaves the country.

Article 16(2) (c)

An immigration officer shall detain for investigation; (I) any person who is attempting to enter or depart from Ethiopia; or (II) any foreigner residing in Ethiopia; in violation of the requirements under this proclamation or of any Regulations issued hereunder.”
