This right is also guaranteed by Article No.41 of the Constitution, which states that everyone has the right to receive higher professional education in public educational institutions. Additionally, according to Article No.13 of the Law on the Legal Status of Foreign Citizens and Stateless Persons in the Republic of Tajikistan, foreign citizens residing in the Republic of Tajikistan, including refugees, have the right to education on an equal basis with the citizens of the country, in accordance with the legislation of the Republic of Tajikistan.

Article 41 - Right to education
Everyone has the right to education. General basic education is mandatory. The state guarantees free mandatory general basic education in public educational institutions. Everyone, within the limits established by law, has the right to receive free general secondary, primary, vocational, secondary vocational, and higher professional education in public educational institutions. Other forms of education are determined by law.

Article 13 - Right to Education
Foreign citizens and stateless persons residing in the Republic of Tajikistan have the right to receive education on an equal basis with the citizens of the Republic of Tajikistan, in accordance with the procedures established by the legislation of the Republic of Tajikistan.
