The Kyrgyz Republic has a constitutionally enshrined principle of protecting the rights and freedoms of all persons on its territory, regardless of their individual characteristics. The Constitution of the Kyrgyz Republic, in particular Article 24, proclaims that no one may be discriminated against on the basis of gender, race, language, disability, ethnicity, religion, age, political or other beliefs, education, origin, property or other status, or other circumstances. The legislation of the Kyrgyz Republic guarantees the right to freedom of religion and belief. In accordance with Article 4 of the Law of the Kyrgyz Republic On Freedom of Religion and Religious Associations dated January 21, 2025 No. 18, everyone is guaranteed the right to freely choose whether to profess or not to profess a religion. Any coercion to determine one's attitude to religion, participate in religious rites or teach religion is prohibited. However, despite the proclamation of the principle of non-discrimination, there are no effective mechanisms to protect the rights of ethnic, religious and political minorities, as well as forcibly displaced persons and stateless persons.
Moreover, the Constitution enshrines the equality of men and women before the law (Article 24), and also establishes that a family is created solely on the basis of a voluntary marriage between a man and a woman (Article 26). Thus, the legal framework of the Kyrgyz Republic officially recognizes only two sexes - man and woman, which limits the possibilities of legal recognition of sexual and gender diversity. Thus, the absence of mention of sexual and gender identity in the Laws makes it impossible to ensure equal protection for persons with a non-binary gender identity or other sexual orientation, which creates additional vulnerabilities for the LGBT+ community. The legal framework of the Kyrgyz Republic proclaims the basic principles of non-discrimination and protection of human rights, however, the absence of specific mechanisms and provisions protecting the rights of sexual, gender and ethnic minorities and other vulnerable groups, creates significant legal gaps.

Article 24 - Non discrimination
1. The Kyrgyz Republic shall ensure the protection of the rights and freedoms of all persons within its territory and under its jurisdiction. No one shall be discriminated against on the basis of gender, race, language, disability, ethnicity, religion, age, political or other beliefs, education, origin, property or other status, or other circumstances. Persons who have committed discrimination shall be held accountable in accordance with the law. Special measures established by law and aimed at ensuring equal opportunities for various social groups in accordance with international obligations shall not constitute discrimination. 2. In the Kyrgyz Republic, everyone is equal before the law and the court. 3. In the Kyrgyz Republic, men and women have equal rights and freedoms and equal opportunities for their realization.

Article 4 - Right to freedom of religion
1. No religion may be adopted as a state or compulsory religion in the Kyrgyz Republic. In the Kyrgyz Republic, everyone is guaranteed the right to freedom of conscience and religion. 2. The right of everyone to freely and independently choose, to profess individually any religion, including the right to change one's religion or beliefs, not to be forced to express one's religious and other beliefs or to renounce them, enjoys absolute protection.
