Do domestic laws and policies allow forcibly displaced and stateless persons to access financial services, including opening a bank account and obtaining loans?

According to the Instructions for working with bank accounts, deposit accounts, approved by the Resolution of the Board of the National Bank of the Kyrgyz Republic dated October 31, 2012 № 41/12, foreign citizens, stateless persons and residents have equal rights when opening bank accounts. However, this requires additional provision of a document confirming the right to stay or reside in the Kyrgyz Republic. 

In addition, in accordance with Appendix 1 to the Regulation on the minimum requirements for credit risk management in commercial banks and other financial and credit organizations licensed by the National Bank of the Kyrgyz Republic approved by the Resolution of the Board of the National Bank of the Kyrgyz Republic dated June 30, 2010 № 52/4, minimum requirements for the borrower's credit file are established. These requirements include the provision of a signed loan application by the borrower, containing mandatory information, including personal data (last name, first name, middle name, residential address, contact information), taxpayer identification number (if any), place of work and occupation. 

Additionally, foreign citizens and stateless persons are required to provide data from a document confirming their right to stay (reside) in the Kyrgyz Republic. For legal entities, the application must include information about the manager, legal address, contact information, full and abbreviated name, type of business and organizational and legal form. 

Also, the loan application must indicate the amount, currency and term of the requested loan, the purpose for which it is received, sources of repayment and the payment plan. The bank also has the right to request information about previously received and repaid loans of the borrower over the past two years, his consent to provide a credit report, as well as other information at its discretion. Thus, based on the above-mentioned regulatory legal acts, including the Resolution of the Board of the National Bank of the Kyrgyz Republic dated October 31, 2012 № 41/12 and Appendix 1 to the Regulation on minimum requirements for credit risk management, refugees have the right to obtain bank loans subject to compliance with the established requirements and provision of all necessary documents.
