Country context

Austria, located in Central Europe, has a well-established legal framework for refugee protection, being one of the early signatories of the 1951 Refugee Convention. The country hosts a diverse refugee population, including those from conflict-affected regions such as Syria, Afghanistan, and Ukraine, alongside longstanding communities of Tibetan and Bhutanese refugees. Asylum seekers and refugees in Austria are accommodated both in urban areas and designated reception facilities. 

Austria's asylum system is governed by national legislation. Refugees granted protection enjoy many rights similar to nationals, though beneficiaries of subsidiary protection often face some limitations, such as restricted access to certain social benefits, including social housing. Refugees from Ukraine, under temporary protection, also experience limitations regarding social benefits, which presents challenges for their integration.

The country’s legal framework includes provisions for stateless persons, as Austria is a party to both the UN Statelessness Conventions and the European Convention on Nationality. However, the country lacks a dedicated statelessness determination procedure, and stateless individuals without residence permits face barriers in accessing rights.
